Safeguarding Vetting & Barring Scheme Announcement

On 19th March 2009 the Home Office set out in greater detail its measures to protect children and vulnerable adults ahead of the launch of the new Vetting and Barring Scheme later this year.

From 12 October 2009 ISA will maintain two new “barred lists” which will replace the existing List 99 and POCA, POVA Lists.  Access to these new lists will be available as part of an Enhanced CRB check, which will be expanded to include more employment and voluntary positions.  People on the barred lists will be barred from a much wider range of activities than previously, and it will become a crime for a barred individual to seek or undertake work with vulnerable groups (and for employers knowingly to take them on).  There will also be a new duty for employers and other organisations to notify ISA of “relevant information” so individuals who pose a threat can be identified and barred from working with vulnerable groups.

From July 2010 the Criminal Records Bureau will introduce a new combined application form for ISA registration and CRB checks.  Employers will also be able to check registration status online and subscribe to be notified if an employee’s registration status changes.

From November 2010 it will be a legal requirement for individuals to register with the ISA if they intend to work or currently work with children and/or vulnerable adults in England, Wales and Northern Ireland, and for employers to check their status.

The changes will have an impact on work based learning and welfare to work providers, as they will require the majority of provider staff to be registered with the Independent Safeguarding Authority (ISA).
